Terms and Conditions

Effective: November 10, 2011

By joining the Jockey® Inner Circle, you agree to the following Terms, Conditions and Rules of the Road (the “Rules”). If you do not agree with, or are not willing to honor the policies described here, please do not register to be an exclusive member of the Jockey® Inner Circle blog program (the “Program”) on behalf of Jockey International, Inc. (“Jockey”) and the Jockey® brand. We reserve the right, at our discretion, to change, modify, add, or remove portions of these Rules at any time. We will notify you of major changes to these rules.

Who can join
Anyone 18 years of age or older and a legal resident of the United States of America is welcome to join. We reserve the right to withhold your participation in a campaign if you do not meet the age requirement.

Anywhere and Everywhere
These Rules apply to group and forum posts, communications, and general behavior of the Jockey® Inner Circle, on Jockey.com® and anywhere where you are representing the Program or the Jockey® brand offline.

Let them know you’re a Jockey® Brand Advocate
First and foremost be honest about your relationship with the Jockey® Inner Circle and the Jockey® brand.

The FTC requires that all incentivized (e.g., earn points, receive prizes or product, etc.) representatives of a company or brand disclose this relationship whenever communicating about the brand. You are responsible for complying with FTC laws and regulations concerning your participation in the Program and any endorsements and testimonials you may provide.

If you are participating in word of mouth activities or otherwise spreading the word about the Program or the Jockey® brand online or offline, you must let people know you are a Jockey® brand advocate or representative and sometimes receive incentives for participating in this Program.

The following are examples of sample language you should use:

“I am a member of the Jockey® Inner Circle. While I do receive complimentary sample products from the Jockey® brand, my opinions are my own.”

“I am a member of the Jockey® Inner Circle and help spread the word about new Jockey® product launches and collections. As a member, I receive sample product and incentives in exchange for participating in brand related activities.”

Best Practices for Representing the Jockey® Brand
When you post or tweet as a member of the Program, you are acting as an ambassador for the brand. Your actions reflect on the integrity of the Jockey® brand. As such, we ask that you follow these Best Practices when talking about the Program or the Jockey® brand:

  • Be honest. Make product statements based upon your actual experience with the product. Share your honest opinions, thoughts and involvement with the product(s).
  • Don’t make false or misleading statements about products. Visit http://www.jockey.com to learn about Jockey® products. If you have a question, please ask us so we can provide you with the most up to date information.
  • Don’t spam – either on the Jockey® site, or on other sites. Repeated and blasted messages are not enjoyed by anyone.
  • Follow the rule of the venue. Facebook and Twitter, for example, have rules on how to communicate–follow them.
  • Never impersonate another individual or entity or misrepresent the source of your post or info.
  • Do not create or utilize technology to generate fraudulent achievement activity including: bots, spiders, email or IM spam.
  • Do not create multiple user accounts or misrepresent yourself in an application/registration.
  • Do not submit repeated posting of unconstructive, negative, or derogatory comments/statements about the Program, Jockey® products or competitor products.
  • Do not misuse Jockey assets including Jockey brands, logos, photos or other electronic images.
  • Do not post images of people without their express permission. All posting must be of people 18 or older, unless posted with parent/legal guardian prior permission.

Stay on Messsage
Sometimes, there are conversations that may be personal or about non-Program matters and more appropriate with another brand ambassador or individual offline or in person. We encourage you to exercise sound judgment in taking such conversations offline. Jockey will not be held responsible for these personal interactions. Further, Jockey® Inner Circle groups and forums are not to be used for:

  • Giving out personal information (email address, phone number, etc.)
  • Promoting, selling or spamming on behalf of any other products or brands
  • Uploading or posting of any computer viruses, harmful files or programs
  • Uploading any material deemed by Jockey staff as inappropriate
  • Any unlawful purpose or activity
  • Posting content or engaging in activity that is:
    • libelous, defamatory (bad mouthing others)
    • pornographic, indecent (dirty)
    • harassing, threatening, harmful, abusive (hurtful)
    • invasive of privacy or publicity rights (mind your own business)
    • inflammatory or otherwise objectionable (going to cause trouble)

Voluntary and a Privilege
This Program is voluntary and a privilege. It serves as a meeting place for an exclusive community. Negative behavior detracts from the experience of this group and will not be tolerated. If you feel that members are engaging in any of the activities listed above, not using proper judgment, making personal attacks or insensitive remarks, please email: blogprogram@Jockey.com.

Share, Share, Share!
As a member of the Program, you will be encouraged to submit video content, links to third party websites, photographs, and text. Please make sure you have the rights to anything you post!

Any material you submit grants Jockey, its affiliated companies, and agents an exclusive right, but not the obligation, to use, Blogger’s likeness, image, photograph, video, voice, and name, and Blogger’s statements or testimonials made about Jockey’s and its business and products, used alone or as combined with promotional, marketing and/or advertising materials, for the purpose of advertising, trade, marketing, merchandising, publicity, research, and/or any other lawful purpose, for and in connection with Jockey and its business and products, in all forms of print and internet media and all other media now known or later developed, in perpetuity and worldwide.

If Jockey accepts your submission and specifically agrees to keep it confidential or not use it, nevertheless, Jockey does not waive any rights it may have to similar or related ideas previously known to Jockey or developed by its employees, or obtained from sources other than you.

You further acknowledge and warrant that the materials submitted by you contain only your own material and content or material and content that you have undeniable rights to use, and that Jockey uses will not violate any third party’s rights.

Jockey is under no obligation to use any materials you submit.

We don’t want to
We reserve the right to suspend, deactivate the account of, or remove anyone from the Program for violation of these Rules, at any time and for any reason. We also reserve the right to void any achievements accumulated by a member who is in violation of these Rules.

Who everybody is
Jockey, the Jockey® Inner Circle and each brand ambassador participating in the Program are each an independent party operating their own business. No one is considered to be the agent, employer or employee of the other or has authority to act in any way on the other party’s behalf. Each party is responsible for their own employment related taxes, costs and expenses that may be incurred while in participating in the Program.

Program Materials and Ownership
Jockey is either the exclusive owner, including copyright therein, or Jockey is authorized to use all print, digital or electronic materials that are provided by Jockey and used in the Program (the “Materials”). You may use only Materials specifically, provided, displayed and identified for such use. You may not, however, distribute, modify, transmit, reuse, repost or use the Materials for public or commercial purposes, including the text, images, audio and video without Jockey’s written permission. You agree not to re-use Materials or posts from other bloggers photos, videos, etc. In particular, you agree not to copy, distribute, republish, upload, post, or transmit anything unless you first get our written consent.

Disclaimer
We are not responsible for any defects or failures associated with the Materials or the Program or any damages (such as but not limited to lost data, profits or other consequential damages) that may result from any such defects or failures. In addition, we makes no guarantees as to the accuracy, currency, content, or quality of material submitted by other Insiders.

Release
Participation in this community requires that you release Jockey (including officers, directors, employees, affiliates, agents, and third party partners) and other members of the Program from claims and damages arising out of your participation in the Program and interaction with other Program members.

Indemnification
YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS JOCKEY, AFFILIATES AND SUBSIDIARY COMPANIES, ADVERTISING AND PROMOTION AGENCIES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, CONSULTANTS AND AGENTS FROM ANY AND ALL THIRD PARTY CLAIMS, LIABILITY, DAMAGES, ACTIONS AND PROCEEDINGS AND/OR COSTS (INCLUDING, BUT NOT LIMITED TO, REASONABLE ATTORNEYS FEES) ARISING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM YOUR PARTICIPATION IN THE PROGRAM, ANY CONTENT YOU SUBMIT, POST, TRANSMIT OR MAKE AVAILABLE, YOUR VIOLATION OF THE TERMS AND CONDITIONS OR YOUR INFRINGEMENT OF ANY INTELLECTUAL PROPERTY OR INFRINGEMENT OR VIOLATION OF ANY OTHER RIGHT OF ANY PERSON OR ENTITY.
